TERMS & CONDITIONS
Terms governing Buildron Supply quotations, orders, material sales, delivery and returns.
Effective September 3, 2026. These Terms & Conditions apply to quotations, invoices, purchase orders, material sales and related supply services provided by Buildron Supply. Any additional or conflicting customer terms apply only if Buildron Supply expressly accepts them in writing. Nothing in these terms waives rights or remedies that cannot lawfully be waived.
1. Quotes, Orders & Acceptance
Quotes are estimates or offers based on the information provided and are subject to availability, final confirmation and any stated expiration date. An order is accepted only when confirmed by Buildron Supply. Customer is responsible for reviewing quantities, manufacturer/model numbers, dimensions, colors, finishes, specifications, delivery information and project requirements before authorizing an order.
2. Pricing, Taxes & Payment
Prices apply only to the quoted quantities and scope and may change before acceptance if supplier pricing, freight, tariffs, taxes, specifications or quantities change. Applicable sales, use or similar taxes are charged unless Buildron Supply receives valid exemption or resale documentation. Deposits and payment schedules stated on a quote or invoice are part of the order terms. Customer remains responsible for amounts properly due under the order.
3. Special-Order & Project-Specific Materials
Special-order, custom, fabricated, cut-to-size, non-stock, project-specific, clearance and manufacturer-restricted materials cannot be canceled, returned or exchanged once Buildron Supply has committed to the supplier or manufacturer, except where required by applicable law or expressly approved in writing by Buildron Supply. Customer should verify all specifications before approval.
4. Returns & Credits
No credit or return will be accepted without prior written authorization from Buildron Supply. Eligible standard-stock returns, when approved, must be unused, uninstalled, undamaged, complete and in resalable condition with original packaging. Proof of purchase may be required. Approved returns may be subject to supplier/manufacturer restrictions, return freight and a disclosed restocking charge where applicable. Authorization to return goods does not itself guarantee a credit; returned goods are subject to inspection. Defective, damaged, incorrectly supplied or nonconforming goods will be handled in accordance with applicable law and any applicable manufacturer warranty.
5. Cancellations
Cancellation requests must be submitted promptly in writing. Buildron Supply may approve cancellation of an uncommitted standard-stock order. Once materials have been ordered, allocated, fabricated, shipped or otherwise committed, cancellation may be unavailable or may be subject to costs already incurred, supplier cancellation charges and applicable law.
6. Delivery, Inspection & Claims
Delivery dates and lead times are estimates unless Buildron Supply expressly agrees otherwise in writing. Delays may occur because of manufacturers, carriers, shortages, weather, jobsite conditions or other circumstances outside Buildron Supply's reasonable control. Customer must provide safe and reasonable delivery access and accurate jobsite instructions. Customer should inspect materials promptly upon receipt and report visible shortages, damage or incorrect items as soon as reasonably possible. Signing a delivery receipt does not eliminate rights that cannot lawfully be waived.
7. Product Information & Project Suitability
Customer and its licensed or qualified project professionals are responsible for determining whether products are suitable for the intended application and comply with plans, specifications, codes and project requirements. Website content, product descriptions and sales assistance do not replace manufacturer instructions, architectural or engineering specifications, code review or professional installation requirements.
8. Manufacturer Warranties
Products may be covered by warranties provided by their manufacturers. Where applicable, Buildron Supply will reasonably assist with information needed to pursue a manufacturer claim. Buildron Supply does not expand or alter a manufacturer's warranty unless expressly stated in a separate written Buildron Supply warranty.
9. Installation & Third Parties
Unless expressly stated in a signed written agreement, Buildron Supply is acting as a material supplier and does not provide installation, engineering, architectural or trade-contractor services. Independent carriers, contractors, installers and other third parties remain responsible for their own work and services.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Buildron Supply will not be liable for indirect, incidental, special or consequential economic losses arising from delay, loss of use, lost profits, lost production or project scheduling impacts. This provision does not exclude liability or remedies that cannot lawfully be excluded or limited.
11. Changes & Written Records
Changes to an accepted order should be confirmed in writing. Quotes, invoices, approved change orders, payment records and written communications may form part of the transaction record. A customer purchase order does not automatically modify Buildron Supply's terms unless the modification is expressly accepted by Buildron Supply in writing.
12. Governing Law
Unless applicable law requires otherwise, transactions with Buildron Supply are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Important: These terms are intended to establish Buildron Supply's standard commercial policies. No website terms can eliminate all business risk or override mandatory consumer-protection, warranty or other applicable law. For significant transactions, public projects, credit sales or installation-related work, transaction-specific documents and legal review may also be appropriate.
